INVESTMENT IN CONSTRUCTION DEVELOPMENT

In the area of investment in construction development the Law Firm provides services such as:

 

  • review of the legal status of the immovable property, including compliance of the investment project with the planning study and the local spatial development plan in force;
  • submitting observations to the draft planning studies and local spatial development plans during public consultations;
  • contesting resolutions on adoption or amendment of a planning study or local spatial development plans (legal representation before administrative courts);
  • representation before architecture and construction administration authorities as well as the construction supervision authorities;
  • drafting developer contracts;
  • legal review of developer contracts and participation in negotiations of their content on behalf of the future buyers;
  • day-to-day assistance with execution of developer contracts (pursuing claims or responding to claims brought forward by parties, in particular for payment, for conclusion of ownership transfer contract, in respect of guarantee and statutory warranty);

LABOUR LAW. EMPLOYMENT OF FOREIGNERS.

In the areas of labour law and employment of foreigners the Law Firm provides in particular the following services:

 

  • providing legal advice and drawing up legal opinions on labour law;
  • drawing up and reviewing contracts related to employment, including employment contracts, service contracts and managerial contracts;
  • representing employers in relations with trade unions;
  • drawing up acts of company’s own employment regulations, including collective agreements, staff rules, remuneration rules, company’s social benefit fund rules;
  • representing Clients in pre-trial procedure, including a comprehensive review of the risk related to the case and conducting settlement negotiations;
  • representing Clients in court proceedings, including cases resulting from termination of employment contract with or without notice, concerning recovery of compensation in respect to an accident at work, for payment of remuneration (also for overtime work);
  • representing employers during surveys conducted by the National Labour Inspectorate (PIP), the Social Insurance Institution (ZUS) and the Border Guard (Straż Graniczna);
  • advising on employment of foreigners from outside of the European Union and the European Economic Area, including Ukraine and Belarus citizens;
  • providing training on labour law.

COURT LITIGATION

The Law Firm assures legal representation of its Clients before common courts and administrative courts, particularly in:

 

  • business litigation, including claims resulting from unfair competition practices;
  • pursuing claims in connection with road accidents, accidents at work and medical malpractice;
  • labour law litigations;
  • divorce proceedings;
  • moral rights violation cases;
  • debt recovery cases;
  • defense in criminal procedures and procedures under Fiscal Offences Act.

“CHF CASES” AND CONSUMER CASES

Within the area of expertise regarding the protection of consumers’ rights the Law Firm provides assistance to Clients in particular by:

 

  • pursuing claims connected with loans associated with a foreign currency (the so-called CHF cases);
  • representing Clients in disputes with Securitisation Funds (FVC);
  • pursuing claims in connection with liquidation of saving insurance policies;
  • representing Clients before enforcement authorities;
  • negotiating, drawing up and entering into settlements leading to reduction of Clients’ debt;
  • pursuing recovery of payments enforced without a legitimate cause.

PUBLIC PROCUREMENT LAW

Assistance for the Contracting authority:

  • legal assistance with preparation of a procurement procedure, including estimation of the value of the procurement, choosing the type of procedure and assistance with drawing up procurement documents;
  • drafting contracts for purposes of public procurement;
  • legal assistance for the contracting authority with evaluation of offers and awarding the contract, in particular by drawing up notices and evaluating admissibility of rejection of an offer;
  • legal assistance at the closing of the procedure, including reviewing possibility of cancelling the procedure;
  • legal assistance with execution of the public procurement contracts, including reviewing the possibility to amend them;

Assistance for the Contractor:

  • drawing up requests for clarification or change of the tender specification or of the description of needs and requirements;
  • review of the compliance of the tender with the expectations of the Contracting authority;
  • introduction of legal remedies, including representation before the National Appeals Chamber.

INHERITANCE AND DIVISION OF ASSETS

Within the legal assistance in inheritance and property cases the Law Firm provides services in respect of:

 

  • securing legal succession and eliminating risk inherent to the process;
  • finding heirs;
  • conducting proceedings for ascertainment of acquisition of the estate of the deceased person and the division of the estate;
  • pursuing claims for compulsory portion of inheritance;
  • handling division of spouses’ assets cases after spousal statutory joint property ends;
  • handling partition of joint property cases;

  • appealing against negative evaluation of the project;
  • representing applicants before administrative courts of both instances following contesting the negative evaluation of the project;
  • legal assistance during the project implementation regularity audit;
  • filing objections to audit follow-up information and final audit follow-up information;
  • appealing against funding recovery orders;
